2008 was a banner year for U.S. democracy and its elections. Many states saw record increases in voter registration – particularly among minority and youth voters – and record increases in voter turnout. Undoubtedly, there was an excitement and new level of attention around this historic election. And, after two presidential elections with angrily disputed results, the 2008 election seemed poised to restore a calm confidence in America’s democratic processes. While the 2008 election ended without the sense of crisis that marked the last two presidential elections, the surface calm may distract from the critical need to continue reforming our election system. Millions of voters continued to be disenfranchised by a variety of election administration failures, and in close elections these failures will continue to undermine national confidence in our democracy.

Federal Court Lawsuit Settlement Brings Ohio into Compliance with NVRA

Resolving a three-year old lawsuit filed against the state of Ohio that charged widespread violations of the National Voter Registration Act (NVRA),  parties in the case have submitted a settlement agreement to the court that should ensure voter registration opportunities for hundreds of thousands of Ohio public assistance clients. Evidence presented in the case had shown that many of Ohio's county public assistance offices were ignoring their responsibilities to provide voter registration to their low-income clients, as required by the NVRA.

Ohio 2008 Post Election Audit Review

Ohio Secretary of State Jennifer Brunner published directives that led to the first post election audits in Ohio. Directive 2008-39 specified voluntary pilot audits after the March Primary election and Directive 2008-113 called for all counties to do audits for the Presidential contest after the November General election. Performing regular post election audits is a vitally important step in measuring and improving election processes in Ohio as well as restoring voter confidence in these processes. Secretary Brunner and all Boards of Elections (BOE’s) that carried out these audits are to be commended for their efforts.

  • Findings and Recommendations based on the observer comments
  • A review of Directive 2008-113

Introduction

A fair and accurate election process is essential to any democracy. After the 2000 election, in which voters experienced significant problems, many people came to doubt that the process was either fair or accurate. Consequently, significant changes in voting technology and in election laws and procedures were introduced. The results have been mixed. For example, numerous reputable reports have documented security, reliability and verifiability issues with electronic voting machines. Voters and advocates have questioned both the validity of specific election results and the integrity of the entire election process. Strengthening requirements for reviews of election procedures, testing voting equipment and auditing vote results can go a long way to restoring confidence in the fairness of the voting process and accuracy of election results.
